The 4th Amendment – Search & Seizure

The Fourth Amendment of the US Constitution requires probable cause for warrants to be issued, but it does not define what probable cause means. Probable cause refers to the balancing of the government’s interest in preventing and investigating crime with an individual’s right to privacy.

It allows law enforcement to enforce the law while protecting individuals from unreasonable intrusions. The concept of probable cause was established in cases such as Carroll v. United States and Brinegar v. United States, which set out the contours of what constitutes probable cause.

The standard of probable cause cannot be quantified into exact percentages and depends on the circumstances of each case. Anonymous tips may be used to establish probable cause, but police must corroborate some aspects of the tip to lead to probable cause.

The requirement of probable cause for search or arrest warrants has two aims: to protect people from unreasonable searches and seizures and to promote police transparency and accountability.
