Chicago Property Crime Attorneys

Arrested for a Property Crime in Chicago?

Contact Chicago Criminal Defense Attorney Josh Adams if you have been arrested for a burglary or property crime in Illinois.

Illinois lawmakers have enacted laws criminalizing burglary (entering a building intending to commit a crime inside), home invasion (entering an inhabited dwelling and causing injury or using or threatening force while armed), and trespass (entering a person’s property without permission). Some of these crimes carry very stiff penalties.

Chicago Burglary Attorneys

Traditionally, burglary was defined as breaking and entering into a home at night with the intent to commit a felony inside. Today, most states have done away with these requirements and a person commits burglary by entering into any building without permission with the intent to commit a crime inside. In Illinois, a person commits the crime of burglary by entering or remaining in a building or vehicle (or any part of a building or vehicle) without permission with the intent to commit theft or a felony (a crime punishable by a state prison term). Burglary is punished more severely if the building is a:

  • school

  • day care center, or

  • place of worship.

(720 Ill. Comp. Stat. § 5/19-1.)

Answers About Getting Arrested in Chicago

Chicago Criminal Defense Lawyers – Arrest FAQs

Below are some common questions and answers related to getting arrested in Chicago and what happens.

Q – How Do you Get Someone Out of Jail?

Answer – The key to getting someone out of jail usually involves paying bail. But before being released, a defendant must complete the booking process, a bureaucratic, often humiliating, procedure. Once that’s completed, the defendant can post bail according to a bail schedule and get released. Or, the defendant awaits arraignment (where the amount of bail can be changed by the judge) or attends a special hearing on setting bail.

In some instances, no bail is required (as explained below). Usually, however, a court will require payment of bail before release. Every defendant who is released must agree to return for scheduled trial and hearing dates, as well as to abide by certain conditions while awaiting trial. Defendants who have committed a capital crime or are considered a high flight risk may be denied bail—that is, these defendants will not be released after arrest and prior to trial. Federal and state laws differ as to when judges have the discretion not to grant bail.

Q – Do you Need an Attorney to Get Out of Jail?

Answer – No, an attorney is not needed to post bail or to get a defendant out of jail. However, a defendant charged with a crime that results in a prison or jail term is entitled to counsel. And a defendant being questioned about matters relating to an alleged crime may request an attorney be present. In these situations, if the defendant cannot afford an attorney, the court will appoint one. The advantage of retaining an attorney at the time of arrest is that the attorney may be able to get the bail reduced or get charges reduced (resulting in lower bail).

CHICAGO BITCOIN ATTORNEYS

Law Offices of Joshua B. Adams Expands Practice to Include Bitcoin and Virtual Currency Law

Building on its experience in defending fraud, money laundering, and cybercrime cases, the Law Offices of Joshua B. Adams has expanded its practice to include bitcoin and virtual currency law.

Bitcoin and virtual currency regulation is a rapidly evolving area of the law. Concern that the bitcoin market is largely unregulated and susceptible to manipulation has caused a spike in federal and state investigations into virtual currency-related financial crimes.

Investigations into money laundering, securities and commodities fraud, money transmitting, and transaction reporting involving bitcoin and virtual currency have dramatically increased since 2013.

If you are being investigated or have been charged with a financial crime involving Bitcoin or virtual currency, contact the Law Offices of Joshua B. Adams.
